Terms of Use – 529 Tracker

App: 529 Tracker (“App”)

These Terms of Use (“Terms”) govern your use of the App and your purchase and use of any subscriptions offered in the App. By using the App, you agree to these Terms.

1. What the App Does (and Doesn’t)

529 Tracker helps you organize and track expenses, reimbursements, and records related to 529 education savings plans. The App does not provide legal, tax, accounting, or financial advice. You are responsible for your own compliance with applicable laws, and you should consult a qualified professional for advice.

2. Eligibility and Account

You must comply with Apple’s App Store Terms and applicable laws. You are responsible for the accuracy of information you enter into the App and for maintaining the security of your device and Apple ID.

3. Subscriptions and Pricing

We offer auto-renewing subscriptions with a free trial:

7-Day Free Trial — try the full app at no cost. After the trial ends, your subscription begins automatically at the regular price unless you cancel before the trial ends.
Monthly: USD $5.99
Annual: USD $54.99 (same features as Monthly; discounted price for paying annually)

Prices may vary by region and are subject to Apple’s tax and currency policies. The Annual plan and Monthly plan include the same access; the Annual plan is simply a better rate.

What’s Included. A 529 Tracker subscription provides access to all in-app features, including unlimited student profiles, unlimited transaction entries, receipt storage, Compliance Center, Projections, Tax Year Reconciliation, AOTC tracking, PDF/CSV export, and cloud sync across your devices. Features available may evolve over time; material reductions in functionality will be communicated in advance.

4. Payment, Renewal, and Cancellation

Payment is charged to your Apple ID at purchase confirmation.
Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period.
Your Apple ID may be charged for renewal within 24 hours prior to the period ending.
You can manage or cancel your subscription in Settings → [your name] → Subscriptions on your device, or see Apple’s guide: https://support.apple.com/HT202039.
Deleting the App does not cancel your subscription.

Failed Payments. If a renewal payment cannot be processed, Apple may attempt to bill the payment method again over a short period (typically up to 16 days). During this time, your subscription may remain active. If payment cannot be collected, your subscription will lapse and access to subscription features will end.

5. Free Trial, Promotions, and Price Changes

Free Trial. New subscribers may be eligible for a 7-day free trial. You will not be charged during the trial period. To avoid being charged, cancel at least 24 hours before the trial ends, through Settings → [your name] → Subscriptions on your device. If you do not cancel before the trial ends, your subscription will automatically begin at the regular price (USD $5.99/month or $54.99/year, depending on the plan you selected), and your Apple ID will be charged. Free trials are limited to one per Apple ID within the subscription group, as determined by Apple. Eligibility is determined by Apple at the time of purchase.

Promotions. From time to time, we may offer promotional or introductory pricing. Specific terms (length, price, eligibility) will be shown in-app before you subscribe.

Price Changes. We may change subscription pricing prospectively. For modest price increases, we will notify you in advance through email, in-app notice, or Apple’s notification system, and the new price will apply at your next renewal. For larger price increases (as defined by Apple’s policies), you will be asked to affirmatively consent before any renewal at the new price; if you do not consent, your subscription will not renew. We will never charge a higher price without the notice or consent required by Apple’s rules and applicable law.

6. Refunds and Consumer Rights

Refunds are handled under Apple’s policies. See Apple’s support article: https://support.apple.com/HT204084. We cannot issue or control refunds for purchases made through the App Store.

Consumer Rights. Where required by law, you may have additional consumer rights, including a right to cancel within a certain period after purchase (for example, a 14-day right of withdrawal for consumers in the European Union and United Kingdom). These rights are handled through Apple as the merchant of record. To exercise them, follow Apple’s process at the link above.

7. What Happens When Your Subscription Ends

If your subscription expires or is canceled, your access to subscription features will end at the conclusion of the current billing period. Your data (entered expenses, receipts, student profiles, and historical records) will remain accessible in read-only or limited form for a reasonable period, allowing you to export your records. Subscribing again will restore full access to your existing data. We do not delete user data solely because a subscription has lapsed, but we may impose reasonable storage limits for inactive accounts as described in our Privacy Policy.

8. Data and Privacy

9. Acceptable Use

You agree not to misuse the App (e.g., reverse engineering, unauthorized access, interfering with service, or using the App for unlawful purposes). We may suspend or restrict access for violations.

10. Intellectual Property

The App and all related content are owned by Charlie Mike Studios LLC or its licensors. You receive a limited, personal, non-transferable license to use the App in accordance with these Terms and Apple’s usage rules.

11. No Warranties; Limitation of Liability

The App is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties and shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim shall not exceed the amount you paid to us for the subscription period in which the claim arose.

12. Changes to the App or Terms

We may update the App and these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (e.g., in-app notice or updated date above). Continued use after changes means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Texas, excluding its conflicts of law rules, and applicable U.S. federal law.
